1) Overview

Welcome to Boy Mama Candle Co (the “Site,” “we,” “us,” or “our”). By accessing or using this Site, placing an order, or interacting with our services, you agree to these Terms & Conditions (“Terms”). If you do not agree, please do not use the Site.

2) Eligibility & Account

  • You must be at least 18 years old (or the age of majority in your state) to make purchases.

  • Some features may require an account. You agree to provide accurate information and to keep your login credentials secure. You are responsible for all activity under your account.
     

3) Products & Orders

  • Product Descriptions: We strive to display accurate product details (scent notes, sizes, photos). Slight variations may occur because many items are hand‑poured and small-batch.

  • Availability: Products are subject to availability. We may limit quantities and discontinue items at any time.

  • Order Acceptance: Your order is an offer to buy. We may accept or reject any order for reasons including product availability, suspected fraud, or pricing errors.

  • Order Changes/Cancellations: Contact us ASAP at contact@boymamacandleco.com. We’ll try our best, but we can’t guarantee changes after an order has been processed or shipped.
     

4) Pricing, Payments & Taxes

  • Prices: Listed in USD and subject to change without notice.

  • Payment: We accept payments via our third‑party processors (e.g., Wix Payments/Stripe/PayPal). By submitting a payment, you authorize the charge to your selected method. We do not store full card numbers.

  • Taxes: Applicable sales taxes are calculated at checkout based on your shipping address and current tax laws.
     

5) Shipping & Risk of Loss

  • Shipping Methods: We ship using common carriers (e.g., USPS/UPS). Estimated delivery dates are not guaranteed.

  • Risk of Loss: Title and risk of loss transfer to you upon carrier’s acceptance. Please inspect packages upon arrival.

  • Wrong Address: Please confirm your address carefully. We are not responsible for shipments delivered to addresses provided incorrectly.

6) Returns, Refunds & Damages

We want you to love your candles! Our Return & Refund Policy (incorporated into these Terms) explains eligibility, timelines, and how to request a return or report damage.

For damaged or incorrect items, email contact@boymamacandleco.com within 14 days of delivery with your order number and photos.
 

7) Gift Cards, Promotions & Store Credit

  • Gift Cards: Non‑refundable, not reloadable, not redeemable for cash (unless required by law), and subject to fraud checks.

  • Promotions/Discounts: Limited time, while supplies last, cannot be combined unless stated. We may modify or cancel promotions at any time.

  • Store Credit: If issued, it may carry an expiration date where permitted by law.
     

8) User Content & Reviews

If you submit reviews, photos, messages, or other content (“User Content”):

  • You grant us a non‑exclusive, royalty‑free, worldwide license to use, reproduce, and display your User Content for marketing and Site operations.

  • You represent that you own or have permission to use the content and that it does not infringe others’ rights or violate laws.

  • We may remove content at our discretion.
     

9) Acceptable Use

You agree not to:

  • Violate laws or infringe intellectual property rights;

  • Interfere with the Site’s security or functionality;

  • Use bots, scrapers, or automated means without permission;

  • Submit false information or engage in fraud;

  • Post harmful, defamatory, obscene, or harassing content.
     

10) Intellectual Property

All content on the Site—text, images, logos, product names, graphics, and code—is owned by or licensed to Boy Mama Candle Co and protected by IP laws. You may not copy, reproduce, distribute, or create derivative works without our prior written consent.
 

11) Third‑Party Services & Links

We may use third‑party services (e.g., payment processors, shipping carriers, analytics, email marketing). Your use of those services may be subject to their terms and privacy policies. We are not responsible for third‑party sites linked from our Site.
 

12) SMS/Email Communications (If Used)

  • Transactional: We may send order confirmations, shipping updates, and service notices.

  • Marketing: With your consent, we may send promotional emails or texts. You can unsubscribe via email links or reply STOP to SMS; reply HELP for help. Message/data rates may apply.
     

13) Privacy

14) Disclaimer of Warranties

To the maximum extent permitted by law, the Site and all products and services are provided “as is” and “as available.” We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non‑infringement. We do not guarantee uninterrupted or error‑free operation.

 

15) Limitation of Liability

 

To the maximum extent permitted by law, Boy Mama Candle Co and its owners, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or use, arising from your use of the Site or products. Our total liability for any claim will not exceed the amount you paid to us for the product(s) at issue.

Some states do not allow certain limitations; if so, portions of this section may not apply to you.
 

16) Indemnification

You agree to defend, indemnify, and hold harmless Boy Mama Candle Co from and against any claims, losses, liabilities, damages, costs, and expenses (including reasonable attorneys’ fees) arising out of your use of the Site, your User Content, or your violation of these Terms or applicable law.
 

17) Governing Law & Dispute Resolution

  • Governing Law: These Terms are governed by the laws of the State of Missouri, without regard to conflict‑of‑laws principles.

20) Termination

We may suspend or terminate access to the Site at any time, with or without notice, for any conduct that we believe violates these Terms or is harmful to other users, us, or third parties.
 

21) Severability & Entire Agreement

If any provision is found unenforceable, the remaining provisions will remain in effect. These Terms, together with any policies referenced (Privacy Policy, Return & Refund Policy, Shipping Policy), are the entire agreement between you and Boy Mama Candle Co regarding the Site and purchases.
